Confiscation of property resulting from a criminal act
On December 16 and 17, 2024, the Judicial Academy, in cooperation with the OSCE Mission to Serbia and the Embassy of the United States of America - INL, organized a two-day training on the subject of "Seizure of property resulting from a criminal offense." The seminar was held in the Fruške terme hotel in Vrdnik and brought together public prosecutors from higher and basic prosecutor's offices, judges from higher and basic courts from the territory of the Novi Sad appeal, members of the Ministry of Internal Affairs of the Republic of Serbia, as well as representatives of the Directorate for Management of Confiscated Property.
The topics covered in this two-day training were:
- Presentation of the legal framework;
- Presentation of the case, facts and evidence;
- Acquaintance of participants with reports and documentation;
- Public prosecutor's decisions regarding the report;
- Acquaintance of participants with documentation;
- Good practice in handling, implementation of orders in the field;
- Preparation of requests for temporary confiscation of property;
- Request for temporary confiscation of property, good practice in handling;
- First-instance procedure for temporary confiscation of property, standards of proof;
- Complaints of defendants and third parties;
- Second instance procedure and standards of proof;
- Making a decision on appeal;
- Review of final decision;
- Request for permanent confiscation of property and final termination of proceedings;
- First-degree and second-degree permanent confiscation of property;
- Judgment based on admissions from civil proceedings and lawsuits for the division of extramarital assets.
The lecturers at this training were:
- Nevenka Važić, judge of the Supreme Court of Serbia (retired);
- Nataša Trninić, public prosecutor for organized crime;
- Igor Veljić, Police Captain, Financial Investigations Unit of the Ministry of Internal Affairs of the RS;
- Saša Ivanić, public prosecutor for organized crime;
- Vladimir Ćeklić, assistant director of the Directorate for Management of Confiscated Property.
