Workshop for the exchange of experiences in connection with public procurement procedures in which a violation of Article 10 of the Law on the Protection of Competition was established

The USAID Public Procurement Improvement Project of the American Agency for International Development, with the support of the Judicial Academy, organized a meeting aimed at exchanging experiences between representatives of the Commission for the Protection of Competition and the Public Prosecutor's Office, in connection with public procurement procedures in which a violation of Article 10 was found of the Law on the Protection of Competition.


The meeting was held on May 15, 2024 at the "Cepter" hotel in Belgrade. The participants were representatives of the Commission for the Protection of Competition, as well as public prosecutors from the Special Departments for Combating Corruption of the Higher Public Prosecutor's Offices in Belgrade, Niš, Novi Sad and Kraljevo. Moderators of the workshop were: Milica Stanković, special advisor in the Department for Legal Affairs, Domestic and International Cooperation, Commission for the Protection of Competition and Miljko Radisavljević, public prosecutor of the Supreme Public Prosecutor's Office.


The training covered the following topics:
-    Competition protection measures and exemption from competition protection obligations according to the Law on Protection of Competition, restrictive agreements and specifics of administrative procedures related to public procurement, in which a violation of Article 10 of the Law on Protection of Competition has been established;
-    Conditions for prosecution for criminal offenses Misuse in connection with public procurement from Article 228, paragraph 1 of the Criminal Code and Conclusion of a restrictive agreement from Article 229, paragraph 1 of the Criminal Code and conditions for optional exemption from punishment prescribed by Article 229, paragraph 2 of the CC;
-    Adoption of conclusions and recommendations in order to define the space and possibilities of cooperation between the Commission for the Protection of Competition and the Public Prosecutor's Office.
