Conducting investigations in cases of abuse by the police

The Judicial Academy, in cooperation with OSCE mission in Serbia, on May 27, 2022, in the hall of the Judicial Academy in Niš, organized a seminar on the topic: "Conducting investigations in cases of abuse by the police".

The training program is designed to ensure that the professionals in charge of these investigations are capable of conducting them in accordance with the relevant requirements set by the European Court of Human Rights. The latest report of the Council of Europe's Committee for the Prevention of Torture was highly critical of the police, citing a significant number of credible allegations of torture and other forms of ill-treatment. The report also mentions the prosecutor's office, noting that it too often does not conduct effective investigations. For this reason, it is recommended that all prosecutors and investigators undergo training on the Methodology for investigating cases of abuse.

 

The training included the following topics:
• the concept of abuse in international law and the law of the Republic of Serbia;
• when the obligation to conduct an investigation and the concept of an effective investigation arise;
• the role of the Department of Internal Control of the MIA and the police in conducting the investigation;
• analysis and evaluation of evidence in public prosecution and court practice, including the practice of the European Court for Human Rights;
• work on hypothetical cases (in groups).

 

The lecturers at this seminar were:

- Radmila Dragičević Dičić, judge Supreme Court of Cassation;
- Tamara Mirović, Deputy Public Prosecutor of the Republic;
- Žarko Marković, legal adviser, OSCE Mission in Serbia.
