Consideration of the specialization of judges and prosecutors in environmental cases

The Judicial Academy of the RS is in cooperation withOSCE mission in Serbia held a conference on October 15, 2025 in Bor on the topic "Considering the specialization of judges and prosecutors in environmental cases".

Conference was held in the hall of Hotel "Albo" in Bor for judges and assistant judges from the Zaječar High Court, Negotin High Court, Bor Basic Court, Knjaževac Basic Court, Dimitrovgrad Basic Court as well as for public prosecutors and assistant prosecutors from the Basic Public Prosecutor's Offices: Negotin, Bor and Zaječar. 

The following topics are presented: 

  • Administrative-legal protection of the environment (Judgment of the Administrative Court in the "Gondola" case, as well as a review of the need for specialization of the judges of the Administrative Court in environmental cases) Lecturer: Jelena Ivanović, judge of the Supreme Court of Serbia 
  • Civil-legal protection of the environment (Judgment of the High Court in Belgrade, a significant step forward in judicial protection of the right to human health and a healthy environment, as well as a review of the specialization of judges of general jurisdiction in environmental cases) Lecturer: Nebojša Đuričić, judge of the High Court in Belgrade  
  • Criminal law - environmental protection (Procedure of the public prosecutor in the environmental protection system and the need for prosecutors to specialize in environmental cases) Lecturer: Danijela Sinđelić, Chief Public Prosecutor, Basic Public Prosecutor's Office in Obrenovac   

The participants were also shown a video on the topic: The importance of environmental courts and the specialization of judges in environmental cases in the world, which was presented by a professor and judge of the Constitutional Court of Belgium. Luc Lavrysen.

In addition, participants were presented with a Practicum for the Application of Environmental Law and Climate Change Law: Challenges and Solutions in Judicial Practice by the author Prof. Dr. Mirjana Drenovak-Ivanović, Danijela Sinđelić, chief prosecutor and Nebojša Đuričić, judge

The practicum will help judges and public prosecutors to solve environmental cases that are extremely complex as well as more efficiently and with understanding. often extensive. 

The conference was moderated by Prof. Dr. Mirjana Drenovak Ivanović and Siniša Važić, judge of the Court of Appeal in Belgrade (retired judge)

This was followed by a discussion that resulted in certain conclusions from which  one of the main ones, yes in the Republic of Serbia, a network of contacts between prosecutors and judges who have acted in environmental cases is necessary as persons who could help judges and prosecutors who act in environmental cases for the first time, as well as professional training of judges and prosecutors in this matter.
