Drafting the first-instance judgements in misdemeanour matters
The seminar was attended by judges of misdemeanour courts under the jurisdiction of the Niš Appellate Court.
The topics discussed at the seminar included:
- Right to a fair trial and the right to a reasoned judicial decision;
- Court judgement structure and method of conviction judgement writing at the first instance;
- Method of acquittal judgement writing at the first instance and an order as another type of ruling in misdemeanour proceedings;
- Structure of judgements and international standards;
- Judgements of the European Court for Human Rights;
- Guidelines for a well-structured judgment and judgement writing;
- Proper citation of the European Court for Human Rights in judgements issued by national courts;
- Practical exercises and application of the guidelines for practical use.
The lecturers on this seminar were: Snežana Andrejević, a judge (retired) of the Supreme Court of Cassation and an advisor to the Council of Europe; Biljana Gavrilović, an Appellate Court judge; Leonida Popović, the President of the Misdemeanour Appellate Court and Milan Marinović, the President of the Misdemeanour Court in Belgrade.
