Presentation of the amended Manual for the application of the principle of opportunities for criminal prosecution

As part of a joint project with the OSCE Mission in Serbia, the Judicial Academy organized the seminar "Presentation of the updated manual for the application of the principle of opportunities for criminal prosecution" at the Court of Appeal in Nis on December 6, 2024. The seminar was attended by chief public prosecutors, public prosecutors, assistant prosecutors, as well as beneficiaries of the initial training of the Judicial Academy from the territory of the Niš appeal.


The topics covered at this seminar were:
-    Previous experiences and observed problems in the application of the principle of opportunities for criminal prosecution and ways to overcome them;
-    Conditions for application, subjects of proposal, proposal and decisions on the proposal for the application of the principle of opportunities for criminal prosecution;
-    Obligations of the suspect in case of postponement of criminal prosecution, concept, types, purpose, choice of type of obligation, method and deadline of execution, records and supervision of the execution of obligations from the order on postponement of criminal prosecution;
-    The decision on the dismissal of the criminal complaint due to the use of the principle of the opportunity of criminal prosecution - adoption, content, delivery, instructions and legal effect in terms of the principle of ne bis in idem.


The lecturers at this seminar were: Dr. Jasmina Kiurski, prosecutor in the Supreme Public Prosecutor's Office, and Dr. Stanko Bejatović, retired professor of the Faculty of Law at the University of Kragujevac.
