Election of the director of the Agency for the Prevention of Corruption - transmission of the test

In accordance with by the Law on Prevention of Corruption, the Judicial Academy has scheduled an examination of the expertise and professional integrity of the registered candidates for the position of director Agencies for the Prevention of Corruption.

The test will be held on December 20, 2022 in Belgrade

Starting at 09:00

6 candidates were invited to the test, and the application deadline for candidates expired on November 14, 2022.

We emphasize that after the procedure for electing members of the Council from 2021, according to the provisions of the Law on Prevention of Corruption, the Judicial Academy is now conducting the testing of candidates for the election of the director of the Agency for Prevention of Corruption, in accordance with Article 12, paragraph 1 of the Law on Prevention of Corruption.

We remind you, THE MINISTRY OF JUSTICE, on the basis of Article 11, paragraph 1 of the Law on Prevention of Corruption ("Official Gazette of RS", no. 35/19, 88/19, 11/21 - authentic interpretation, 94/21 and 14/22) , announced the PUBLIC COMPETITION FOR THE CHOICE DIRECTOR AGENCIES FOR PREVENTION CORRUPTION.

The public competition was published in the "Official Gazette of the Republic of Serbia", number 117/2022 of October 26, 2022.

 

The Board of Directors of the Judicial Academy, at the session held on November 14, 2022, passed the decision that the following are appointed as members of the Commission for the selection of directors of the Agency for the Prevention of Corruption (hereinafter: the Agency):


1. Marko Jocić, judge of the Court of Appeal in Belgrade
2. Dr. Dobrosav Milovanović, full professor at the Faculty of Law, University of Belgrade i
3. Ljubivoje Đorđević, public prosecutor in the First Basic Public Prosecutor's Office

That the following be appointed as members of the Appeals Committee for the selection of the Director of the Agency:


1. Katarina Manojlović Andrić, judge of the Supreme Court of Cassation
2. Ranka Vujović, Head of the Department for Administration, Work and Public Services and Assistant Director of the Republic Secretariat for Legislation
3. Tomislav Kilibarda, public prosecutor in the Appellate Public Prosecutor's Office in Belgrade

Applications submitted for the public competition for the election of the director of the Agency for the Prevention of Corruption were submitted by the following persons:

  1. Dejan Damnjanovic
  2. Kosta Sandić
  3. Dragan Sikimić
  4. Vladimir Babic
  5. Vasilija Brocic
  6. Goran Jevtic

THE PROCEDURE PASSING THE TEST


The test consists of three parts.


• In the first part of the test, the competence of the candidate is evaluated, in the second part of the test, the professional integrity of the candidate for the position of the Agency's director is evaluated, and in the third part of the test, the work program of the Agency, which the candidate presents to the commission members, is evaluated. The test evaluates only professional qualifications, knowledge and skills that are specified in the test program issued by the minister responsible for judicial affairs. For the first part of the test, the candidate can get a maximum of 70 points, and for the third part of the test, a maximum of 30 points.


• The second part of the test is evaluated with "passed" and "failed" grades. A candidate who receives a grade of "failed" cannot be nominated for the election of the Director of the Agency.


• The Commission for the Selection of the Director of the Agency, within 15 days from the end of the test, publishes the results of the test.


The candidate has the right to object to the decisions of the Commission for the Selection of the Director of the Agency within three days from the date of publication of the test results, i.e. from the day of rejection of the application for the public competition.

ABOUT the complaint from paragraph 10 of this article is decided by the Complaints Commission within three days from the expiry of the deadline for complaints.

After the test has been conducted and the complaint procedure has been completed, the Commission for the Selection of the Director of the Agency submits to the minister in charge of judicial affairs a ranking list of candidates according to the success achieved in the test.

The minister responsible for judicial affairs is obliged to propose to the National Assembly candidates who achieved at least 80 points on the test.

If the National Assembly decides not to elect any candidate or if there are no candidates who achieved at least 80 points in the exam, the public competition is re-announced within 30 days from the day when the National Assembly decided, i.e. from the day when the ranking list of candidates from Article 12, paragraph 12 of this law.
