Consideration of the specialization of judges and prosecutors in environmental cases
The Judicial Academy, in cooperation with the OSCE Mission in Serbia, held a conference on the topic: "Considering the specialization of judges and prosecutors in environmental cases". The conference was held on October 10, 2024 in the premises of the OSCE Mission in Belgrade, and is intended for prosecutors and judges who act in environmental cases.
The following topics are presented:
- Administrative-legal protection of the environment (Judgment of the Administrative Court in the "Gondola" case, as well as a review of the need for specialization of the judges of the Administrative Court in environmental cases); Lecturer: Jelena Ivanović, judge of the Supreme Court of Serbia
- Civil-legal protection of the environment (Judgment of the High Court in Belgrade, a significant step forward in judicial protection of the right to human health and a healthy environment, as well as a review of the specialization of judges of general jurisdiction in environmental cases); Lecturer: Nebojša Đuričić, judge of the High Court in Belgrade
- Criminal protection of the environment (Procedure of the public prosecutor in the system of environmental protection and the need for prosecutors to specialize in environmental cases); Lecturer: Danijela Sinđelić, Chief Public Prosecutor, Basic Public Prosecutor's Office in Obrenovac
The participants were also shown a video on the topic: "The importance of environmental courts and the specialization of judges in environmental cases in the world" presented by professor and judge of the Constitutional Court of Belgium, Luc Lavrysen.
The conference was moderated by prof. Dr. Mirjana Drenovak Ivanović and Siniša Važić, judge of the Court of Appeal in Belgrade (retired judge).
This was followed by a discussion that resulted in certain conclusions, one of the main ones being that the specialization of judges and prosecutors in environmental cases is necessary in the Republic of Serbia.
